Home & Lake ("we," "us," or "our") operates the website homeandlake.com and related real estate services for Old Hickory Lake and the Middle Tennessee area. This policy explains what information we collect, how we use it, how we protect it, and the choices you have.

Home & Lake is a Tennessee-licensed real estate brokerage (Firm License #266503). Britton Kinnard, Broker/Owner, is the individual responsible for data handling under this policy.

Information we collect

We collect only the information you choose to provide, plus basic technical data needed to operate the site.

Information you give us

  • Contact form submissions: name, email address, phone number (optional), and the content of your message.
  • Seller valuation requests: the above, plus property address and your anticipated timeframe for selling.
  • Correspondence: emails, texts, or calls you send to us in response to a listing, inquiry, or ongoing transaction.

Information collected automatically

  • Usage data: pages visited, referring URL, approximate location (country/region level via IP), browser type, and device category. Collected via Cloudflare Web Analytics and Microsoft Clarity in aggregated, privacy-respecting form.
  • Security logs: IP addresses of form submissions are logged briefly to prevent abuse and spam.

We do not use third-party advertising cookies on homeandlake.com.

How we use your information

  • To respond to inquiries and provide the real estate services you've requested.
  • To send lead notifications to the business owner (SMS/email) when you submit a form on the site. These internal notifications go only to Britton Kinnard.
  • To follow up with you about properties, valuations, or ongoing transactions you've initiated.
  • To improve the website and understand which content is useful to visitors (via aggregated analytics).
  • To comply with legal obligations under Tennessee real estate law and federal regulations.

We do not sell your personal information. We do not share it with third parties for their own marketing purposes.

SMS and text messaging

If you provide a phone number, we may contact you by SMS about the specific inquiry or transaction you initiated. Message and data rates may apply. Message frequency varies based on the status of your inquiry. You can opt out at any time by replying STOP to any text, or by emailing britton@homeandlake.com. Phone numbers and SMS consent are not shared with third parties or affiliates for marketing purposes.

Service providers we use

We use a small number of service providers to deliver the site and communications. These providers process data on our behalf under their own privacy commitments:

  • Cloudflare — website hosting, DNS, and privacy-respecting analytics
  • Google Workspace — email for britton@homeandlake.com
  • Twilio — sending SMS lead notifications to the business owner
  • Resend — transactional email delivery for form submissions
  • Microsoft Clarity — aggregated usage analytics (heatmaps, session counts)

We only share the minimum information needed for each provider to perform its function.

How we store and protect your information

Contact form submissions are stored in Cloudflare's encrypted storage (KV) for up to one year for record-keeping, and in Britton's email archive for the duration of the client relationship. Transaction-related records are kept for the period required by Tennessee real estate law (typically three to seven years after close).

We take reasonable measures to protect your information, including encrypted transport (HTTPS), access controls on hosting accounts, and password managers for credentials. No system is perfectly secure, and we cannot guarantee against all risks.

Your choices and rights

  • Access or correction: Email us to request a copy of the information we have about you, or to correct inaccuracies.
  • Deletion: You can request deletion of your contact record at any time, subject to any legal record-retention requirements for transactions.
  • SMS opt-out: Reply STOP to any text, or email us.
  • Email unsubscribe: Follow the unsubscribe link in any promotional email, or email us directly.
  • Analytics opt-out: Standard browser "Do Not Track" signals are honored where technically possible.

Residents of states with specific privacy laws (e.g., California's CCPA) have additional rights to know, delete, and opt out of sale. We do not sell personal information, but will honor verified requests under applicable law.

Children's privacy

Home & Lake's services are directed to adults interested in real estate transactions. We do not knowingly collect information from anyone under 16. If you believe a child has provided information through our site, contact us and we will delete it.

Changes to this policy

We may update this policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be communicated through the website.
